In the State of Georgia, employers are not required by law to provide severance payments to employees upon separation of employment for any reason. However, many employers do offer severance payments in an employment contract, separation agreement or employee handbook for a variety of reasons such as talent recruitment and consideration for restrictive covenants. Once severance packages are offered in a contract, contractual obligations are triggered which create enforceable rights for departing employees.
As an employee who is departing from an employer requires knowledge of severance package negotiation and preferably… the assistance of experienced counsel.
